Prior to or at a court date, the prosecutor and Georgia Criminal Defense Attorney will meet and discuss a potential or lesser sentence and potentially reach an agreement on reducing  or dismissing the criminal charges.

An Experienced Georgia Criminal Defense Attorney will understand his client’s case thoroughly so that they can effectively discuss the case with the prosecutor and present their client’s side as effectively as possible.  Both sides will be looking for holes in the other side’s case.  If the Georgia Defense Attorney can present to the prosecutor the holes in the State’s case, the likelihood of getting a lesser sentence, reduction in charges, pretrial diversion, or an outright dismissal are greater.

On the other side, if the prosecution has a very strong case, an Georgia Defense Attorneycan communicate to his client informed advice on whether to take the case to trial.

Not all cases will reach a plea agreement, therefore, it is imperative that the defense attorney also prepare for a trial. This includes reviewing evidence, interviewing witnesses, and communicating with the client.

Plea Negotiations are a crucial aspect of the criminal justice system. It is very important to remember that those negotiations are confidential. Engaging into plea negotiations with the State is not a sign of guilt by the defendant, but can provide incentives to both sides to close the case out without a trial.
